Egypt's first Islamist president to be sworn in

CAIRO (Reuters) - Egypt's President-elect Mohamed Mursi takes his oath on Saturday, a day after the Islamist leader pre-empted the formal ceremony by swearing himself in before ecstatic crowds in Tahrir Square and warning off generals trying to curb his powers.

They have already clipped the prerogatives of the bearded leader now in the palace once occupied by Hosni Mubarak, who is serving a life sentence 16 months after Egyptians toppled him.

"I swear by God that I will sincerely protect the republican system and that I respect the constitution and the rule of law," Mursi said on Friday to wild cheers from the crowd, many of whom were followers of his once-banned Muslim Brotherhood.

Addressing the "Muslims and Christians of Egypt", he promised a "civil, nationalist, constitutional state", making no mention of the Brotherhood's dream of creating an Islamic order.

Mursi is to be sworn in officially at 11 a.m. (05.00 a.m. EDT) by the constitutional court, rather than by parliament as is usual.

The court dissolved the Islamist-dominated lower house this month in one of several measures intended to entrench military influence over Egypt long after Mursi assumes the presidency.

"There is no power above people power," Mursi said in Tahrir Square, crucible of the revolt that ended Mubarak's 30 years in power. "Today you are the source of this power."

His defiant speech was a clear challenge to the army, which also says it embodies the will of the people and which sees itself as the guarantor of national interests and the state.

An army council headed by Field Marshal Mohamed Hussein Tantawi took over from Mubarak when he quit on February 11, 2011 and has long pledged to make way for an elected president by July 1.

Tantawi, Mubarak's defense minister for 20 years, would hand over to Mursi in a televised ceremony on Saturday after the president was sworn in, army sources said.

Under the military council's rule, Egypt has experienced a bumpy and sometimes violent transition in which parliamentary and presidential elections have been held, without setting the country on a clear path to democracy or constitutional rule.

LIVING IN LIMBO

Egypt remains in political limbo, without a constitution, a lower house of parliament or any clarity about the role of a military establishment anxious to stay in the driving seat.

An assembly that is supposed to write a new constitution has begun work after its predecessor fell apart amid disputes over whether Islamists were over-represented in a country with a 10 percent Christian minority and many secular-minded liberals.

Egypt is also more polarized than ever.

Mursi narrowly won a run-off vote this month against Ahmed Shafik, a former air force chief and Mubarak's last prime minister, but many voters were dismayed at having to choose between an Islamist and a man seen as a remnant of Mubarak's era.

Egypt will find it hard to attract the investment, loans and foreign aid it needs to revive an economy blighted by months of turmoil and uncertainty until political stability returns.

International Monetary Fund Managing Director Christine Lagarde called Mursi to discuss the economic challenges facing Egypt and how the international lender can best help, an IMF spokesperson said on Friday.

"The MD reiterated that the IMF stands ready to support Egypt and looks forward to working closely with the authorities," the spokesperson said.

Lagarde also congratulated Mursi on his election as president, "which represents an important step forward in Egypt's transition," the spokesperson said.

However, no timetable has been set for an IMF staff visit to Egypt to discuss a $3.2 billion IMF loan. That "will depend on the formation of the government," the spokesperson said.

Complicating the process, the generals seized new powers this month, giving themselves veto rights over the drafting of a new constitution, naming a National Defence Council to run defense and foreign policies and decreeing their control of all military affairs.

The military's insistence that Mursi take his oath before the constitutional court and his defiant riposte in Tahrir sets the stage for a protracted struggle for power in Egypt.

The military, the source of every previous president in the Arab republic's 60-year history, also runs business enterprises accounting for an estimated one-third of the economy.

It does not intend to jeopardize the $1.3 billion a year it receives in military aid from the United States to back Egypt's 1979 peace treaty with Israel, widely criticized by Islamists.

Mursi has said he will respect Egypt's international obligations and does not want to take the country back to war.

His speech in Tahrir, greeted with cheers from tens of thousands of supporters, signaled a determination to use popular legitimacy to defeat entrenched military power.

"Say it loud, Egyptians, Mursi is the president of the republic," the crowd chanted. "A full revolution or nothing. Down with military rule. We, the people, are the red line."

(AP) ? Attorney General Eric Holder on Thursday became the first Cabinet member held in contempt of Congress, a rebuke pushed by Republicans seeking to unearth the facts behind a bungled gun-tracking operation and dismissed by most Democrats as a political stunt.

The vote was 255-67, with more than 100 Democrats boycotting.

African-American lawmakers led the walkout as members filed up the aisle and out of the chamber to protest the action against Holder, who is the nation's first black attorney general. Democratic leader Nancy Pelosi of California joined the boycott, saying Republicans had gone "over the edge" in their partisanship.

Seventeen Democrats voted with Republicans in favor of the contempt vote, while two Republicans ? Reps. Scott Rigell of Virginia and Steven LaTourette of Ohio ? joined other Democrats in voting against it.

The National Rifle Association pressed hard for the contempt resolution, leaning on members of both parties who want to stay in the NRA's good graces.

Andrew Arulanandam, an NRA spokesman, said all 17 Democrats who voted for criminal contempt had previously received an "A'' grade from the organization.

Holder said afterward that the vote was merely a politically motivated act in an election year

"Today's vote may make for good political theater in the minds of some, but it is ? at base ? both a crass effort and a grave disservice to the American people. They expect ? and they deserve ? far better," Holder said in New Orleans.

The attorney general said the House vote would result in an unnecessary court fight. Republicans "were not interested in bringing an end to this dispute or even obtaining the information they say they wanted," he said. "Ultimately, their goal was the vote that ? with the help of special interests ? they now have engineered."

Republicans cited Holder's refusal to hand over ? without any preconditions ? documents that could explain why the Obama administration initially denied that a risky "gun-walking" investigative tactic was used in Operation Fast and Furious. The operation identified more than 2,000 illicitly purchased weapons. Some 1,400 of them have yet to be recovered in the failed strategy to track the weapons.

The vote on a criminal contempt resolution sent the matter to the U.S. attorney for the District of Columbia, who is under Holder. In previous contempt cases, federal prosecutors in the nation's capital have refused to act on congressional contempt citations against members of their own administration.

A separate vote on civil contempt passed 258-95, with 21 Democrats supporting it. It will allow the House to hire its own attorney to bring a civil lawsuit in an effort to force Holder to turn over the documents.

In past cases, courts have been reluctant to settle disputes between the executive and legislative branches of government.

During the debate before the vote, Republicans said they were seeking answers for the Michigan family of Brian Terry, a Border Patrol agent killed in December 2010 in a shootout with Mexican bandits. Two guns from Fast and Furious were found at the scene.

Democrats insisted that they, too, wanted the Terry family to have all the facts, but argued that only a more thorough, bipartisan investigation would accomplish that.

Terry's family issued a statement through the Brian Terry Foundation, saying: "The Terry family takes no pleasure in the contempt vote against Attorney General Eric Holder. Such a vote should not have been necessary. The Justice Department should have released the documents related to Fast and Furious months ago."

The NRA contended the administration wanted to use Operation Fast and Furious to win gun control measures. Democrats who normally support the NRA but who vote against the contempt citations would lose any 100 percent ratings from the group.

That could affect whether they get endorsements from the powerful organization, particularly if Republican opponents surface who are strong NRA backers. But a former NRA board member and the longest-serving House member, Rep. John Dingell of Michigan, argued gun control was not at issue. He failed in attempt to head off the contempt votes.

The Congressional Black Caucus, explaining its boycott, said in a letter to the House that "Contempt power should be used sparingly, carefully and only in the most egregious situations" and the GOP leadership had "articulated no legislative purpose for pursuing this course of action."

The dispute is both legal and political. Republicans asserted their right to obtain documents needed for an investigation of Operation Fast and Furious ? focusing on 10 months in 2011 after the Obama administration initially denied guns were allowed to "walk" from Arizona to Mexico. By year's end, the administration acknowledged the assertion was wrong.

President Barack Obama asserted a broad form of executive privilege, a legal position designed to keep executive branch documents from being disclosed. The assertion ensures that documents will not be turned over any time soon, unless a deal is reached between the administration and congressional Republicans.

In the debate, Rep. Jackie Speier, D-Calif., said the contempt motions were "Fast and foolish, fast and fake."

Rep. Rich Nugent, R-Fla., took the opposite view, arguing, "A man died serving his country, and we have a right to know what the federal government's hand was in that."

For the past year and a half, some Republicans have promoted the idea that Holder and other top-level officials at the Justice Department knew federal agents in Operation Fast and Furious had engaged in gun-walking.

Two of Holder's emails and one from Deputy Attorney General James Cole in early 2011 appear to show that they hadn't known about gun-walking but were determined to find out whether the allegations were true.

"We need answers on this," Holder wrote. "Not defensive BS. Real answers."

The Justice Department showed the selected emails on Tuesday to Republican and Democratic staffers of the House Oversight and Government Affairs Committee, in an effort to ward off the criminal contempt vote against the attorney general.

The full contents of the emails were described to The Associated Press by two people who have seen them. Both people spoke on condition of anonymity because they were not authorized to speak about them publicly.

In Operation Fast and Furious, agents of the federal Bureau of Alcohol, Tobacco, Firearms and Explosives abandoned the agency's usual practice of intercepting all weapons they believed to be illicitly purchased. Instead, the goal of "gun-walking" was to track such weapons to high-level arms traffickers who had eluded prosecution and to dismantle their networks.

Gun-walking long has been barred by Justice Department policy, but federal agents in Arizona experimented with it in three investigations during the George W. Bush administration before Operation Fast and Furious. The agents in Arizona lost track of several hundred weapons in that operation.

UK probing more banks for interest rate fixing

(AP) ? More global banks are being investigated for the alleged financial market manipulation that led to fines of $453 million against Barclays Bank, British Treasury chief George Osborne said Thursday, driving financial stocks lower.

The day before, U.S and British regulators fined Barclays for manipulating the interest rate ? the London interbank offered rate (LIBOR) ? to its advantage between 2005 and 2009. The rate is used to price mortgages and consumer loans.

Osborne said Barclays was not the only bank to be involved in market fixing. There are investigations in several countries involving, among others, Citigroup in the U.S., Switzerland's UBS, and Britain's HSBC and Royal Bank of Scotland.

The banks' share price fell sharply as investors expected hefty fines and tighter regulation. Barclays shares closed down 15.5 percent, RBS 11.5 percent, HSBC 2.6 percent and Lloyds Banking Group 3.9 percent.

UBS shares were down 3.8 percent in afternoon trading, and Citigroup shares were down 0.1 percent.

Britain's Financial Services Authority cited evidence that Barclays traders were, in some cases, in touch with people in other banks.

"Banks were clearly acting in concert," said Andrew Tyrie, a British lawmaker who chairs the influential Treasury Committee in the House of Commons. "I fear it's not going to be the end of the story, that we are going to find that other banks have been involved."

Tyrie said his committee would summon Barclays chief executive Bob Diamond to explain what happened at the bank.

Though Diamond has decided to waive his 2012 bonus in the wake of the fines, he's facing calls to step down.

"If Bob Diamond had a scintilla of shame, he would resign," said Matthew Oakshott, a member of the House of Lords. "If Barclays' board had an inch of backbone between them, they would sack him."

Prime Minister David Cameron, when asked whether Diamond should resign, said he thinks "the whole management team have got some serious questions to answer. Let them answer those questions first."

The massive fines are unlikely to be the end of the pain for Barclays. The cost of lawsuits related to the LIBOR scandal will likely be bigger, said Sandy Chen, banking analyst at Cenkos Securities.

"Since Royal Bank of Scotland, HSBC and Lloyds Banking Group have also been named in lawsuits, we expect they will also face significant fines and damages. We are penciling in multi-year provisions that could run into the billions," Chen said.

The LIBOR is an average rate set by banks each morning that measures how much they're going to charge each other for loans. That rate, in turn, affects returns on complex products such as interest rate derivatives contracts.

"These contracts may sound exotic but they are the bread and butter of our financial system and are used by businesses and public authorities every day, and they affect the mortgage payments and loan rates of millions of families and hundreds of thousands of firms, large and small," Osborne said.

The U.S. Justice Department said Barclays would not face criminal prosecution, subject to certain conditions, but individual employees or officers could be prosecuted.

Diamond waived any bonus for this year, as did finance director Chris Lucas, chief operating officer Jerry del Missier and Rich Ricci, the chief executive of corporate and investment banking. Diamond said the decision reflected "our collective responsibility as leaders."

Martin Taylor, who was CEO of Barclays between 1995 and 1998, said the bank's board will have to make a decision whether Diamond can carry on in his post.

Though Taylor does not believe Diamond ordered anyone to fiddle the rates, and thinks Diamond should stay if he can "help clean out the stables," he told BBC radio that only the board can make that judgment.

The traders involved in the manipulations worked in Barclays Capital, the investment bank which Diamond headed between 2005 and 2009.

Former Barclays chief Taylor said he was confident that Diamond hadn't sanctioned the misbehavior in the unit, but added that the company's culture might have been a factor behind the misdemeanors.

"Bob runs an extraordinarily competitive and aggressive ship, and that is one reason why Barclays Capital has been very successful in the first decade of the century," Taylor said.

"And I think that when people are pushed to go to the limit, you know what traders are like, they sometimes go beyond it. They don't need to have an instruction from headquarters to go beyond it, they think it is what the bank might expect, perhaps."

"Somebody at senior level somewhere will certainly have known. I can't believe that Barclays haven't identified who that is," Taylor added.

Moderate exercise tied to lower breast cancer risk

NEW YORK (Reuters Health) - Women who exercise moderately may be less likely than their inactive peers to develop breast cancer after menopause, a study published Monday suggests.

Researchers found that of more than 3,000 women with and without breast cancer, those who'd exercised during their childbearing years were less likely to develop the cancer after menopause.

The same was true when women took up exercise after menopause.

And it did not take a vigorous workout; regular exercise at any intensity level was linked to a lower breast cancer risk, the researchers say.

The findings, reported in the journal Cancer, add to a number of past studies tying regular exercise to lower breast cancer odds.

But like those past studies, this latest one can only point to a correlation: It does not prove that exercise, itself, is what cut women's breast cancer risk.

Still, there are reasons to believe it can, said lead researcher Lauren McCullough, of the University of North Carolina, Chapel Hill.

One possible way is indirectly, by reducing body fat, McCullough said in an interview. Excess body fat is related to higher levels of certain hormones, including estrogen, as well as substances known as growth factors, which can feed tumor development.

But exercise might also have direct effects, McCullough said -- by boosting the immune system or the body's ability to clear cell-damaging "free radicals."

That is all speculation for now.

But, McCullough said, the findings do support the general health recommendation that adults stay active throughout their lives.

"What we can say is, exercise is good for you," she told Reuters Health. "We don't know what it's going to do for any one woman."

DIFFERENCE SEEN AFTER MENOPAUSE

The study included 1,500 Long Island women with breast cancer and 1,550 cancer-free women the same age. All were interviewed about their lifetime exercise habits and other lifestyle factors, like smoking and drinking.

The researchers found a connection between exercise and breast cancer risk only among women who'd already gone through menopause.

Those who'd exercised for 10 to 19 hours a week in their "reproductive years" -- the years between having their first child and going through menopause -- were one-third less likely to have breast cancer than women who'd been sedentary during that time.

Women who'd started exercising after menopause also had a lower risk. If they averaged 9 to 17 hours a week, they were 30 percent less likely to have breast cancer than their inactive peers.

Of course, women who exercise can be different from sedentary women in many ways. So McCullough's team accounted for differences in education, income, smoking and certain other factors. Exercise was still linked to lower breast cancer risk.

Then the researchers took a closer look at body weight.

They found among relatively lighter women, exercise was linked to lower breast cancer. And for obese women, it may have mitigated the increased breast cancer risk tied to their excess pounds.

The study has a number of limitations. It relied on women's memories of their exercise habits over a lifetime, for one.

And any study like this can only look at broad patterns, McCullough said.

Exercisers as a whole were less likely than sedentary women to develop breast cancer. But no one can say what effect exercise might have on any one woman's risk of breast cancer -- if it does have an effect at all.

In the U.S., the average woman has about a 1-in-8 chance of developing breast cancer in her lifetime, and a 1-in-36 chance of dying from it, according to the American Cancer Society.

For now, McCullough said her findings support what's already recommended for good health. And they suggest that women might benefit even if they start exercising after menopause.

"It's never too late to start," she said "Our evidence suggests that if you start after menopause, you can still help yourself."

There was no link seen between exercise and breast cancer for the nearly 1,000 women in the study who developed breast cancer before menopause.

According to McCullough, that may be because breast cancer earlier in life has different causes compared with after menopause -- when most breast cancers occur.

He explained it was a young snake, about 3-years-old, measuring about three meters (yards) in length and judging by the snake?s behavior, it was most likely being raised in a home. He warned that while many people like raising snakes, this is not a particularly great snake for the home since it can grow quite large.

Wikipedia: Burmese Python (Python molurus bivittatus) is the largest subspecies of the Indian Python and one of the 6 largest snakes in the world, native to a large variation of tropic and subtropic areas of Southern- and Southeast Asia. They are often found near water and are sometimes semi-aquatic, but can also be found in trees. Wild individuals average 3.7 meters (12 ft) long, but may reach up to 5.74 meters (19 ft).

(AP) ? Two great-grandmothers in their 80s have parachuted from a plane to raise money for a veterans' food pantry in northwest Ohio.

The Lima (LY'-muh) News (http://bit.ly/NwU102) reports 83-year-old Marjorie Bryan and 82-year-old Marianna Sherman parachuted Saturday at the Allen County Airport in Lima. They made tandem jumps with retired Sgt. 1st Class Michael Elliott, who has done tandem jumps with former President George H.W. Bush.

The women parachuted to raise money for the local chapter of Blue Star Mothers of America and its veterans' food pantry. Blue Star members are mothers whose children have served in the military.

Bryan is from Lima. Sherman is from Kenton. Bryan likes parachuting so much she wants to accompany Bush if he jumps for his 90th birthday. She would be 85.

ScienceDaily (June 25, 2012) ? The United States' space exploration program is taking a critical step forward with a successful major technical review of the core stage of the Space Launch System (SLS), the rocket that will take astronauts farther into space than ever before.

The core stage is the heart of the heavy-lift launch vehicle. It will stand more than 200 feet (61 meters) tall with a diameter of 27.5 feet (8.4 meters).

NASA's Marshall Space Flight Center in Huntsville, Ala., hosted a comprehensive review. Engineers from NASA and The Boeing Co. of Huntsville presented a full set of system requirements, design concepts and production approaches to technical reviewers and the independent review board.

"This meeting validates our design requirements for the core stage of the nation's heavy-lift rocket and is the first major checkpoint for our team," said Tony Lavoie, manager of the SLS Stages Element at Marshall. "Getting to this point took a lot of hard work, and I'm proud of the collaboration between NASA and our partners at Boeing. Now that we have completed this review, we go from requirements to real blueprints. We are right on track to deliver the core stage for the SLS program."

The core stage will store liquid hydrogen and liquid oxygen to feed the rocket's four RS-25 engines, all of which will be former space shuttle main engines for the first few flights. The SLS Program has an inventory of 16 RS-25 flight engines that successfully operated for the life of the Space Shuttle Program. Like the space shuttle, SLS also will be powered initially by two solid rocket boosters on the sides of the launch vehicle.

The SLS will launch NASA's Orion spacecraft and other payloads, and provide an entirely new capability for human exploration beyond low Earth orbit. Designed to be safe, affordable and flexible for crew and cargo missions, the SLS will continue America's journey of discovery and exploration to destinations including nearby asteroids, Lagrange points, the moon and ultimately, Mars.

"This is a very exciting time for the country and NASA as important achievements are made on the most advanced hardware ever designed for human space flight," said William Gerstenmaier, associate administrator for the Human Exploration Operations Mission Directorate at NASA Headquarters in Washington. "The SLS will power a new generation of exploration missions beyond low Earth orbit and the moon, pushing the frontiers of discovery forward. The innovations being made now, and the hardware being delivered and tested, are all testaments to the ability of the U.S. aerospace workforce to make the dream of deeper solar system exploration by humans a reality in our lifetimes."

The first test flight of NASA's Space Launch System, which will feature a configuration for a 77-ton (70-metric-ton) lift capacity, is scheduled for 2017. As SLS evolves, a two-stage launch vehicle configuration will provide a lift capability of 143 tons (130 metric tons) to enable missions beyond low Earth orbit and support deep space exploration.

Boeing is the prime contractor for the SLS core stage, including its avionics. The core stage will be built at NASA's Michoud Assembly Facility in New Orleans using state-of-the-art manufacturing equipment. Marshall manages the SLS Program for the agency.

Across the SLS Program, swift progress is being made on several elements. The J-2X upper-stage rocket engine, developed by Pratt & Whitney Rocketdyne for the future two-stage SLS, is being tested at Stennis Space Center in Mississippi. The prime contractor for the five-segment solid rocket boosters, ATK of Brigham City, Utah, has begun processing its first SLS hardware components in preparation for an initial qualification test in 2013.

Recent weeks have seen much entertainment industry and legal attention to an aggressive dispute between two networks over a pair of "reality" television shows. CBS has broadcast Big Brother in the United States since 2000, and it got wind of a prospective but as-yet uncompleted show entitled The Glass House it believed ABC was developing for a June 18, 2012 debut. In general, both shows involve a group of people living together in a house, sequestered from the outside world, continuously monitored by numerous television cameras, and on both shows contestants are eliminated over a respective season until there is a prize winner. There can be no doubt that, in the mind of the public, the industry press and blogosphere, and, often, even in the words of plaintiff's learned counsel in this kind of case, the second and subsequent shows in what is a typical cycle of seriatim reality programs with a similar premise -- without any aspersions cast, think of American Idol, America's Got Talent, and The Voice, or Pawn Stars and Hardcore Pawn, or any reality show about finding, buying, selling, or remodeling a house -- inevitably provoke pejorative rubrics such as "copycat" and "knock-off" despite the absence of meaningful judicial concurrence. The simple problem faced by irked plaintiffs searching for a way to prohibit subsequent reality TV shows of similar content, however, is that American copyright law was neither Constitutionally conceived nor legislatively drafted to prohibit that sort of "copying". Indeed, it was designed to permit it. The operative principle is that copyright law does not protect basic ideas -- that is, say, a show featuring a talent competition or the activities in a pawn shop -- but, rather, only the original and concrete expression of such ideas. The difference is embodied in a doctrine called the "idea-expression dichotomy", and while a precise, one-size-fits-all definition of the idea-expression boundary has always been elusive, for our purposes a progression from abstraction to concreteness in detail is helpful and illustrative. To violate an author's valid copyright, it is thus not enough that another work comprises merely similar ideas, or even that its ideas were, as commonly understood, "copied". The standard instead is one the courts call substantial similarity, which evidences a significantly higher coincidence of shared expressive content.

The dimensions of comparison in substantial similarity analysis may include plot, characters, dialogue, sequence of events, setting, tone, and theme, which the works in question must be demonstrated to share as concrete expression to a high degree. Some plaintiffs, seemingly aware that they can adduce only scant similarities among the above touchstones, also rely on a stopgap claim of "compilation", alleging that facts or ideas are collated or ordered in a similar way. The Supreme Court has ruled, however, that a compilation- based copyright is on narrow grounds, or "thin", such that the infringement must be virtually identical, a level beyond substantial similarity. Moreover, there are certain classes of similarities, however, even if present, that cannot form the basis for a finding of substantial similarity between two works if they constitute one or more of the following: a mere inexpressive idea, fact, or concept; predictable stock content common to a genre; material found in third-party works extant prior to the plaintiff's creation; a taking considered a "fair use" for legal and policy reasons; or material already in the public domain. Applying the above generally, while copyright law would not protect the bare idea for a movie with an abstract, archetype lawman, a bad guy, and a shootout, it would much more likely protect the aggregate, concretely described and expressive lawman, bad guy, and shootout elements of, say, High Noon or Die Hard.

The courts have extended to reality television the same copyright principles and standards as were developed primarily in the fictional or dramatic context. In a line of cases dating back to -- guess what? -- the 2003 prior match where CBS lost its claim that ABC's I'm a Celebrity, Get Me Out of Here! infringed Survivor, courts that decided the matter have declined relief to reality TV plaintiffs, largely on the basis that the defendants' shows simply shared ideas or stock elements. The actual progression of incident, the concrete specifics of the "characters" (the hosts, announcers, contestants, coaches, and other participants), the words they uttered, and the expressive content, design, and detail of the setting, all taken together, were quite different where the law demands that they be quite -- or "substantially" -- similar, and even where they shared certain similar ideas.

Were the governing copyright principles to be otherwise, then, for example, the first talk show featuring an announcer, a live band, a stand-up comedian host, a raised stage arranged with a guest couch and the host's desk, silly games played with audience participation, two celebrity guests, and a concluding musical act could purport to secure an exclusive copyright to the above as against subsequent talk shows with the listed similarities, an intuitively absurd result, and one contrary to sound policy. The same could be said of two classic situation comedies, I Love Lucy and The Dick Van Dyke Show, where both shows feature a family which includes a father in show business, a housewife mother, a son named Ricky or Ritchie, set principally in the family's living room and the father's workplace, where the family closely interacts with its immediate neighbors who often drop in unannounced, and where the mother's antics often get her in trouble with her husband. Once again, the two shows are not substantially similar because they only share the commonality of the above abstract ideas, not their expression, which lies in the concrete realization of those ideas, and which, compared show-to-show and episode-to-episode, differed fundamentally as to story, more specific character details, and so on. Had the above or comparable lists of idea similarities been exclusively protected at the dawn of talk shows or situation comedies, the development of entire genres of television and those who work in them might have been impermissibly curtailed.

Litigants would be well-served to think of copyright protection as a cordon sanitaire of expression within which proprietors enjoy defined and exclusive rights for limited times, but beyond which other creators are free to use more general ideas, concepts, and certain other content. As the Ninth Circuit federal appellate court (which includes California) enunciated in Satava v. Lowry, Congress

granted artists the exclusive right to the original expression in their works, thereby giving them a financial incentive to create works to enrich our culture. But it denied artists the exclusive right to ideas and standard elements in their works, thereby preventing them from monopolizing what rightfully belongs to the public.
